Oxy Systems, Inc., understands that privacy is important and we take protecting the privacy of our customers and visitors to our websites very seriously. This privacy policy (the "Privacy Policy") is designed to help you better understand the information we gather from our websites located at http://www.oxysys.com and http://www.phling.com (collectively, the "Site"), how we handle the information once we gather it, whether we disclose it to anyone, and the choices you have regarding our use of the information. Please note that this Privacy Policy applies only to information we gather online at the Site and not to other companies' or organizations' websites to which we may link, even if they market our products or use the phling! or Oxy Systems names or to other mediums by which we gather information. Each time you visit the Site and/or use an Oxy Systems product, by doing so, you agree to the policies described in this Privacy Policy at that time. You agree that by using this Site, you are affirmatively consenting to our use and disclosure of the information you provide to us, as further described in this Privacy Policy.
We may gather certain usage information like the number and frequency of visitors to the Site. This information may include which URL you just came from, which URL you next go to, what browser you are using, and your IP address. We only use such data in the aggregate so that it is not identifiable to any particular individual. Our collection and use of this aggregated data helps us determine how many of our customers use parts of the Site and to conduct internal research on our users' demographics, interests, and behavior to better understand and serve you.

Our business is to provide mobile phone-based services and products, so we will always maintain a mobile phone number for each individual who has registered with the Site and opened an account with Oxy Systems. We seek such information to provide products and/or services that more closely reflect your preferences. In addition, we may use such Personal Data to improve our marketing and promotional efforts, to analyze usage of the Site, improve our content and product offerings, and customize our Site’s content, layout, and services.
Our primary goal in collecting information via the Site is to provide you with a smooth, efficient, and customized experience. This allows us to provide features that most likely meet your needs, and to customize our service to make your experience easier. In operating the Site, we may collect certain personally identifiable data, as well as non-identifiable data, all as described further below.

We also use this information to authenticate you when you connect to the phling! server using the phling! applications on your mobile phone and personal computer.
We may use third party service providers to facilitate our services and therefore we may provide some of your Personal Data directly to them. In addition, we employ other companies and individuals to perform functions on our behalf. Some examples include fulfilling orders, delivering packages, sending postal mail and email, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments, and providing customer service. These service providers have access to Personal Data and may use it as needed to perform their functions, but may not use it for any other purpose, except that they may aggregate your Personal Data with similar information from other customers in a manner that does not personally identify you.
We may also offer our phling! Service on a co-branded or jointly-marketed basis with certain third party business partners. In such case, your Personal Data will be shared with such third party business partners.
Oxy Systems cooperates with law enforcement inquiries, as well as other third parties, to enforce laws, such as intellectual property rights, fraud and other rights. We can (and you authorize us to) disclose any information about you to law enforcement or other government officials as we, at our sole discretion, believe necessary or appropriate, to respond to claims or legal process, to protect the property of Oxy Systems or the safety of its employees or others, to investigate fraud, intellectual property infringements, or other activity that is or may be illegal or may expose us or you to liability.
It is possible that Oxy Systems could be acquired by another business entity. Should such a combination occur, you should expect that Oxy Systems will share some or all of your Personal Data to continue to provide service. You may receive notice of such event (to the extent that it occurs), and we will request that the new combined entity follow the practices disclosed in this Privacy Policy or notify you of any changes.
Except as otherwise expressly included in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. To the extent that you disclose your information to other parties, different rules may apply to their use or disclosure of information you provide to them. Since Oxy Systems does not control the privacy policies of third parties, some of whose services may be offered through our Site, you are subject to the privacy policies of those third parties. This Privacy Policy shall not apply to any unsolicited information you provide to Oxy Systems through the Site or through any other means. This includes, but is not limited to, information posted to any public areas of the Site, such as bulletin boards, as well as any ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, "Unsolicited Information"). All such Unsolicited Information shall be deemed to be non-confidential and Oxy Systems shall be free to use, reproduce, disclose, and distribute such Unsolicited Information to others without limitation or attribution.
Oxy Systems does not allow individuals under the age of thirteen to register with the Site and/or provide Oxy Systems with any Personal Data through the Site. Oxy Systems recognizes that parents may purchase our products and services for family use, including for use by minors. Any information collected from such usage will appear to be that of the subscriber (the parent) and treated as such under this Notice. Further, in accordance with the Children's Online Privacy Protection Act and this Notice, Oxy Systems does not design or intend for its products or services to collect personally identifiable information from children under the age of 13. If our policies change in that regard, we will obtain verifiable parental consent before any collection, use, or disclosure of such information. Remember that if a child under 13 uses our services with or without your permission to access a site on the Internet, that site's privacy policy (including treatment of information your child provides to that site) will govern. Oxy Systems uses standard industry practices to safeguard the confidentiality of your Personal Data. We employ security techniques to protect such data from unauthorized access by users inside and outside the company.
Unfortunately, perfect security does not exist on the Internet, and therefore, Oxy Systems makes no representations or warranties with regard to the sufficiency of these security measures. Oxy Systems shall not be responsible for any damages that result from a lapse in compliance with this Privacy Policy because of a security breach, technical malfunction, or similar problem. Personal Data that is submitted to the Site will be collected, processed, stored, disclosed, and disposed of in accordance with applicable U.S. law. If you are a non-U.S. User, you acknowledge and agree that we may collect and use your Personal Data outside your resident jurisdiction as described in this Privacy Policy.
In addition, such Personal Data may be stored on servers located outside your resident jurisdiction. U.S. law may not provide the degree of protection for your information that is available in other countries.
